2008 New Year's Day Essay of China Business Law Open Source Project

Well, have not wriiten any blog for long. First of all, in my own name would like to thank all of my friends who cared and supported the CBL project. My special gratitudes to the core members of CBL team who have done great contribution to the correcting of website in year 2007.

Thanks to the work, that I made friends with a lot of software engineers who made me acquainted with more industry application software, open source software and database application etc. With their full backup, I built my own website in Chinese five years ago. Now http://www.5izy.cn has been widely applauded by industry itself and has established links with several domestic top legal website.

As far as I remembered, we initially started CBL during National Days in October 2006. At that time several foreign case lawyers and I were aware of few issues:

1.China's reform and opening up strategy has been successfully evolved for the past thirty years, however, foreign investors who just stepped into China were still not quite clear of China Law Frame, investment policies etc. some of them still held info which was old and even incorrect.

2.In the cooperation process with foreign lawyers, due to the lack of knowledge in each other's law system backward and incorrect info has been obtained.

3.Recently some domestic large scale enterprises implemented globalization strategy, and those international law firms who could deal with transnational transactions nearly monopolized the legal service industry. Monopoly ended up in high lawyer cost for the investors, which greatly affected the globalization step of those well-developed medium scale enterprises. 

To my way of thinking, the mainstream for the former thirty years of China's reform and opening up was foreign investment, the 30 years afterwards would be globalization of China's enterprises. Thus we kept close relationship with foreign professional consultation institutions (e.g. law firm, accountant firm, business consultation firm etc.), as luck always favor those who are ready. Consequently, that was how China Legal Resourses, predecessor of CBL was founded. Right after several weeks, we adjusted the website frame and renamed it as " China Business Law". Yet, we encountered bottle neck.

1.Core members of the website are primarily backbone lawyers. Due to heavy nwork load, it was difficult to spare time to update the website.

2.English is not native language for domestic lawyers, and writing in English on a regular base has become a burden. Therefore some really capable lawyers have quitted out from CBL team.

In 2007 I have come into contact with a lot of open resource software while serving for some IT companies, which was very important to CBL. Gradually I started using idea such as Linux open resource software into CBL. It was again a National Day's holiday when I adjusted the website, which was the most vital step as have radiated the development direction of CBL.

1.China Business Law(CBL)was an open resource project founded by Chinese lawyers with main purpose to establish a whole English professional database related with China business.

2."China Business Law" is not "business law" in Anglo-American Law system per se, besides there is no such category of "Business Law" in China law system also. Initially we used "China Business Law" to transfer the message of" This is a law website related to China Business". And now we have even more accurate definition.

3.CBL open resource project layout:
To establish a whole English professional database related with China business; To study foreign investors' business operation in China based on law; To meet the consultation demands of those enterprises who wish to globalize. The website is maintained together by the registration member, all volunteers, who separately publishes the article in each one’s specialized domain, equivalent to researching and developing sharing open resource software code. We used the invitation registration system to guarantee quality, and did study together to reorganize these specialized information to the classified knowledge database.

CBL user object:

1.Those foreign professionals who pay attention to China business, such as lawyer, accountant, consultant who provides business or management plans, etc. CBL is an academic exchange platform.

2.Those foreign investors, businessmen, administrant who pay attention to China business etc. CBL would be a well-classified knowledge database.

Being an initiator, we firstly based on four taches, namely establishment, operation, alteration and termination, and started special research on foreign investment in China, company set up, governance, merge and acquisition, intellectual property, real estate exploitation, E-business, franchise, contract dispute, laboring personnel, bankruptcy liquidation, litigation, arbitration etc. and would release the research achievements on CBL.

With the interposition of Raincity Studios from Canada, the website became pretty mature from the technical aspect, that is: Blog + Forums + Groups + Wiki

Blog: Influx personal articles, no matter how the website would be developed, personal harvest would be preserved and reflected (the quantity and quality of articles represent the contribution of individual user)

Forums: Tradition interactive platform.

Groups: Regional interactive funtion (I named it as "brainstorm")

Wiki: With more and more high quality articles, could easily come up with a knowledge database.

Groups would be the main module for future development. Consultation companies from Australia and Canada are very much keen on joining in, thus waiting to hear our official notice. Foreign lawyers who pay attention to China business would use this interactive platform to keep contact with domestic lawyers and seek more opportunity to cooperate.

The website users are mainly foreign and domestic lawyers, accountants, financial managers, consultant etc. I do hope after some trial operation, and improvements in process and details, groups, such as Sino-USA groups, Sino-Australia Groups, Sino-Canada groups etc., could be established to exchange opinions and ideas:

Apart from the above frame, there are still so many details need to be finalized, even gramma mistakes in some of the existing articles could have been occurred. Yet as long as we have the pursuit of perseverance and dedication, I am confident of the prosperity of CBL.
